SHEAMOISTURE & SUPERDRUG MOBO AWARDS PROMOTION

Introduction

(a) Promoter and Data Controller: Unilever UK Limited (Brand Shea Moisture), Unilever 3 St James Road, Kingston Upon Thames KT1 2BA (“Shea Moisture”) (please do not send entries to this address). 

(b) Shea Moisture has appointed Umbrella Risk Management Ltd (company number 5397976) of Dodwell House, Chilton Business Centre, Chilton, Buckinghamshire, HP18 9LS to be the data processor and to manage the prize fulfilment (“Umbrella”). By entering this Prize Draw, you agree to these Terms and Conditions (the “Terms”) and any decisions reached by SheaMoisture, which are final and binding in all matters related to this Prize Draw.

(c) The Prize Draw starts at 00:00 (BST) on  4th October 2023 and ends at 23:59 (GMT) on 31st October 2023 (the “Prize Draw Period”). 

Who can enter this Prize Draw?

(a) Participants must:

i. be residents of, and have a postal address in the United Kingdom (excluding Channel Islands). 

ii. be aged 18 or over.

iii. a valid email address

(b) The Prize Draw is not open to directors, members, partners, employees, agents or consultants of SheaMoisture, any person who directly or indirectly controls or is controlled by SheMoisture, or any supplier of goods or services in connection with the Prize Draw, or their spouses, life partners, business partners or immediate family members.

(c) By entering the Prize Draw, you hereby warrant that all information submitted by you is true, current and complete. SheaMoisture reserves the right to verify the eligibility of all participants and disqualify a participant for submitting false information.

(d) No purchase necessary to enter the promotion.

How does the Prize Draw work?

(a) To enter the Prize Draw, participants must:

i. Visit https://www.sheamoistureuk.com/superdrug-mobo-awards-competition.html

ii. complete the entry form (which will require entrants’ first and last name, email addresss  and and answer a question about your hair type). (an “Entry”) (being “Entries” when referred to in the plural).

(b) Each participant can only enter the Prize Draw once (once total during the Prize Draw Period). For the avoidance of doubt, if a participant has entered more than once, only their first Entry will be accepted and constitute a valid Entry. If a submission fails to satisfy any or all requirements of an Entry, it will not be counted as a valid Entry and will be void.

(c) All Entries must be received by SheaMoisture during the Prize Draw Period, or they will be void. SheaMoisture will not accept responsibility for:

i. Prize Draw Entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

ii. any change in dates, times or cancellations or other arrangements that may prevent a winner from accepting, taking, or using a prize.

(e). Following the expiration of the promotion (23.59 (GMT) on 31 October 2023), five (5) winners will be selected at random, using a random computer-generated process, to receive the Prize (defined below).  The winners of the Prize will be selected from all valid Entries received during the Prize Draw Period.

(f) The winners of the Prize will be notified on 7th November 2023, via a telephone callemail adress provided by the participant on the entry form to accept their prize and confirm their mobile number to arrange a call to share their bank details and postal address for prize fulfilment.

(g) The Prize (defined below) must be claimed in accordance with the instructions in the Notification by 23:59 GMT on 14th November 2023 (the “Claim Period”). If after 2 attempts a winner has not been contacted successfully, or has been unavailable, or hasn’t accepted the Prize within the Claim Period, the prize is forfeited, and an alternative winner will be chosen. Alternative winners will have until 23:59 GMT on 21th November to claim the Prize. In order to receive their prize, the winners will also need to provide SheaMoisture with any further information requested by SheaMoisture, in accordance with the instructions set out in the Notification. 

(h) Winners should ensure that any personal data (including bank details) is obscured or redacted before sharing. 

(i) The winner may be required to provide SheaMoisture with proof of identification in order to verify compliance with the eligibility requirements for the Prize Draw.

(j) If a winner is found to be ineligible or fails to comply with the Terms, then the winner may, in SheaMoisture’s sole discretion, be disqualified and an alternative winner will be selected.

What is the Prize

(a) There will be five (5) Prize winners.

(b) Prize winners will receive:

i. One pair of Mobo Awards e-tickets for them and a guest. The event will take place in December 2023 the exact date of the event will be disclosed closer to the date and communicated to the winners once available; and 

ii. 1 nights hotel accommodation bed and breckfast basis chosen by the Promoter (1 room, double occupancy),and

iii. £300 transferred to the bank account nominated in the Notification, for both the winner and their guest’s travel and food substance to the Prize (for the avoidance of doubt, this shall be £300 for the winner and their guest, not £300 each). (together the ‘Prize’)

(c) The location of the Mobo Awards will take place in the UK and the exact location of the event will be disclosed closer to the event and to winners once available. 

(d) The details of the events timings will be confirmed upon acceptance of prize fulfilment.

(e) It is the responsibility of the winners and their guests to ensure that they are available for the dates of the Mobo Awards and that they comply with any terms and conditions that apply to the Mobo Awards, including any set out on https://beta.mobo.com or prize and its value will be forfeited.

(f) The Promoter is not liable for any missed events or opportunities or expenses incurred as a consequence of flight cancellation/delay or ground transportation delay.   It is the Winner's responsibility to organise transport to the hotel accomodation and to the Mobo Awards event. 

(g) Unless expenses are expressly stated in these Terms and Conditions to be expenses which are part of any Prize, all other expenses incurred by the winners and their guests in preparation for, or during the trip, are the responsibility of the winners and their guests including but not limited to all other meals, transfers, insurance and any applicable insurance excesses, spending money, incidentals, mini-bar, laundry, room service, telephone calls and all other ancillary costs that are not included.

(h) The Prize fulfillment will be organised by Umbrella Risk Management Limited Umbrella Risk Management Ltd (company number 5397976), whose registered office is at Dodwell House, Chilton Business Centre, Chilton, Buckinghamshire, HP18 9LS

(i) The winner is responsible for informing Umbrella of any dietary requirements or allergies for themselves and their guest for the hotel accommodation.

(j) Prize winner and their guest will be solely responsible for all taxes, and for any other fees or costs associated with the prizes they receive, regardless of whether it, in whole or in part, is used.

(k) For the avoidance of doubt, the winner’s chosen guest to the Prize must also be over the age of 18, and will be required to provide proof of identification in order to verify this. 

(l) Entry to the Prize shall be at the sole discretion of Mobo Awards. It is the responsibility of the winner and the winner’s guest to ensure that they comply with the rules of the Prize at all times. SheaMoisture shall not be responsible for any decision by Mobo Awards to deny entry to the winner and/or the winner’s guest.

(m) The fulfilment of Mobo Awards e-tickets will be managed by Umbrella. Once the winners are contacted by Umbrella, they will be requested to provide their bank details for travel and food substance allowance and their postal address for verification.

(n) Prize is non-transferable, non-exchangeable, and have a cash value of zero. 

(o) The Prize is for personal use only and is not for resale. The Prize may not be resold under any circumstances. The Prize may be forfeited in the event that SheaMoisture determines that the Prize is being misused. SheaMoisture reserves the right to substitute a prize of an equal or greater value in its absolute discretion. 

(p) The Promoter will not be responsible for replacement of any lost or stolen match tickets once they are in winner's possession or in the possession of the winner’s guest.

General 

(a) The winners may be required to participate in reasonable post-event publicity and agree to any such content being shared across SheaMoisture social media channels, including recognised partner channels. Subject to the winner being 18 years and above, the winner and guest may be filmed, photographed, interviewed by SheaMoisture during the events – subject to the winner and their guest’s approval. Where approval is granted, SheMoisture shall have a perpetual, worldwide, non-exclusive, royalty-free, sub-licensable, and transferable license to use, reproduce, distribute, and make derivative works of such footage, photographs, testimonials in any media and through any media channel. 

(b) SheaMoisture reserves the right to amend the rules of the Prize Draw, to withdraw the Prize Draw at any time if circumstances beyond its control make this unavoidable, or to cancel the Prize in the event of non-compliance with these Terms.

(c) SheaMoisture will use your personal details to contact you for administrative purposes relating to this Prize Draw.

(d) The Promoter reserves the right to disqualify any winner whom it determines has used multiple names or email addresses to enter the Promotion and to require them to return any prize they may have won. The Promoter will verify the eligibility of all entrants. The Promoter will require as much information as it considers reasonably necessary for this purpose and the Prize may be withheld unless or until the Promoter is satisfied with the verification.

(e) Entrants who use anonymous email services such as, but not limited to, GuerillaMail, Dispostable, Mailinator or Apple’s “Hide my Email” feature will not be entered in to the promotion.

(f) If you have elected to be added to SheaMoisture email database, you will also receive promotional emails with offers, news, products, and information. You can unsubscribe at any time.

(g) By entering the promotion, all entrants will be deemed to have consented to the transfer of their personal data to Umbrella and SheaMoisture for the purposes of the administration of this promotion, and any other purposes to which the entrant has consented. Unless the Entrant has consented, any personal information shared with SheaMoisture and/or Umbrella will be deleted following the completion of the Prize Draw.

(h) Winners’ name and details will be shared with Umbrella (the organisers of the Prize) in accordance with the Privacy Policy (both linked in clause 5(h) and 5(g) below) and Umbrella’s Privacy Policy (https://team-umbrella.co.uk/privacy-policy) solely for the purpose of administering the Prize. 

(i) SheaMoisture will keep your personal information safe and will use your personal information in accordance with the privacy policy available on its website (https://www.unilevernotices.com/privacy-notices/united-kingdom-english.html)

(j) The winner’s surname and county will be made available. The winner will have the right to object to this information being published or to request a reduction in the amount of information being published. SheaMoisture may be required to provide this information to the relevant regulatory authorities.

(k) The decision of SheaMoisture regarding any aspect of the Prize Draw is final and binding and no correspondence will be entered into about it.

(l) Any cancellation or changes will be posted on the Prize Draw page (http://www. https://www.sheamoistureuk.com/superdrug-mobo-awards-competition-tcs.html.  

(m) With the exception of liability which cannot be excluded by law, SheaMoisture is not liable for, and you release SheaMoisture from, liabilities relating to any direct or indirect loss or damage which is suffered as a result of entering the Prize Draw, failing to win or receive any emails or inability to contact the potential prize winner for any reason whatsoever, winning, accepting or using a Prize.

(o) These terms and conditions and any issues or disputes which may arise out of or in connection with these terms and conditions (whether such disputes or issues are contractual or non-contractual in nature, such as claims in tort, for breach of statute or regulation or otherwise) shall be governed by and construed in accordance with English law. Entrants hereby irrevocably submit to the exclusive jurisdiction of the English courts to settle any such dispute or issues.
